2. Fitness and Health Disclaimer

Pilates and other forms of physical activity involve inherent risks.

By participating in our services, you acknowledge that physical exercise may involve risks including, but not limited to:

  • Muscle soreness

  • Strains or sprains

  • Falls

  • Aggravation of existing injuries

  • Joint or muscular injury

  • Dizziness or fatigue

  • Other physical injuries

You are responsible for determining whether you are physically able to participate in Pilates or other exercise activities.

Pilates with Katia does not provide medical advice, medical diagnosis, physical therapy, or medical treatment.

Information provided during sessions, classes, events, on our website, or through our communications is intended for general fitness and educational purposes only and should not be considered a substitute for advice from a physician, physical therapist, or other qualified healthcare professional.

If you have an injury, medical condition, are pregnant, recently gave birth, recently underwent surgery, or have any concerns regarding your ability to exercise, you should consult an appropriate healthcare professional before participating.

3. Your Responsibility Before Participating

You agree to inform your instructor of any relevant health conditions, injuries, physical limitations, pregnancy, recent surgeries, or other circumstances that may affect your ability to safely participate.

You agree to:

  • Follow reasonable safety instructions provided by the instructor

  • Stop exercising if you experience unusual pain, dizziness, shortness of breath, or other concerning symptoms

  • Participate only at a level that is appropriate for your abilities

  • Use Pilates equipment and other exercise equipment only as instructed

  • Communicate any discomfort or concerns during the session

You remain responsible for your own health, safety, and physical limitations.

4. Bookings

Appointments, classes, and events may be booked through our website, through Acuity Scheduling, or through another booking method provided by Pilates with Katia.

A booking is not guaranteed until it has been confirmed.

Some services may require advance payment, a deposit, or full payment at the time of booking.

Availability may vary.

5. Payments

Prices for services will be displayed or communicated before purchase or booking.

Unless otherwise stated, payment may be required:

  • At the time of booking

  • Before the scheduled session or event

  • According to an invoice or agreed payment schedule

Applicable taxes, processing fees, travel fees, venue fees, or other charges may be added when appropriate and disclosed before payment.

All prices are subject to change. Price changes will not normally affect services that have already been purchased and confirmed.

6. Private Session Cancellation Policy

Private and semi-private sessions require advance notice if you need to cancel or reschedule.

Unless otherwise communicated at the time of booking, we request at least 24 hours' notice for cancellations or rescheduling.

Appointments canceled with less than the required notice may:

  • Be charged in full;

  • Forfeit a session from an existing package; or

  • Lose any applicable deposit.

Exceptions may be made at our discretion for emergencies or extraordinary circumstances.

Repeated late cancellations or missed appointments may result in future bookings requiring advance payment.

7. Late Arrivals

If you arrive late to a private or group session, the session may still end at its originally scheduled time.

The full session fee may still apply.

We cannot guarantee additional time following a late arrival because other clients or events may be scheduled afterward.

8. Group Classes

Group classes may have limited capacity and may require advance registration.

Participants are responsible for arriving on time and following all instructions provided by the instructor.

Classes may be modified, relocated, postponed, or canceled due to circumstances including instructor availability, venue issues, weather, safety concerns, or insufficient enrollment.

When Pilates with Katia cancels a paid class, participants may be offered a rescheduled class, class credit, or refund depending on the circumstances.

9. Events and Private Events

Pilates with Katia may provide Pilates instruction for private events, corporate events, wellness events, celebrations, community events, or other group experiences.

Event bookings may be subject to additional terms concerning:

  • Deposits

  • Final payments

  • Number of participants

  • Travel

  • Venue requirements

  • Equipment

  • Setup and cleanup

  • Cancellation deadlines

  • Weather

  • Rescheduling

Any event-specific proposal, invoice, agreement, or booking confirmation may contain additional terms. If those terms conflict with these general Terms of Service, the specific event agreement will generally control for that event.

10. Event Deposits and Cancellations

Certain events may require a non-refundable deposit to reserve the requested date and time.

The remaining balance may be due before the event according to the terms communicated at booking.

Because event dates may be reserved specifically for a client, event cancellation policies may differ from standard private-session cancellation policies.

Any applicable cancellation or refund terms will be communicated before the event is confirmed.

11. Packages and Class Credits

If Pilates with Katia offers session packages, memberships, class credits, promotional offers, or prepaid services, additional terms may apply.

Unless otherwise stated:

  • Packages are intended for the person who purchased them;

  • Packages may not be transferred or resold without permission;

  • Promotional pricing may be subject to expiration dates or limitations; and

  • Unused sessions may be subject to expiration periods disclosed at purchase.

12. Refunds

Completed sessions and classes are generally non-refundable.

Refund eligibility for prepaid sessions, events, packages, workshops, or other services will depend on the cancellation policy and terms communicated at the time of purchase.

Pilates with Katia reserves the right to issue credits, refunds, or exceptions when appropriate.

13. Instructor Cancellations

Occasionally, Pilates with Katia may need to cancel or reschedule a session because of illness, emergencies, weather, venue problems, or other circumstances.

When we cancel a prepaid service, we will generally offer an appropriate rescheduling option, credit, or refund.

14. In-Home Private Sessions

When services are provided in a client's home or another private location, the client agrees to provide a reasonably safe and appropriate environment for the session.

This includes adequate space to exercise and an environment reasonably free from hazards.

The instructor may refuse to begin or may stop a session if conditions appear unsafe.

Travel fees or geographic service limitations may apply to in-home sessions.

15. Equipment

Pilates equipment and props should only be used as directed.

Participants should immediately notify the instructor if they notice damaged equipment or experience any problem while using equipment.

Clients participating from home are responsible for ensuring that personally owned equipment is properly maintained and suitable for use.

16. Personal Property

Pilates with Katia is not responsible for the loss, theft, or damage of personal belongings brought to sessions, classes, or events except where responsibility cannot legally be excluded.

Participants should keep personal belongings secure.

17. Children and Minors

Participants under the age of 18 may be required to have permission from a parent or legal guardian before participating.

A parent or legal guardian may also be required to complete applicable registration, consent, and liability documents on behalf of the minor.

18. Photos and Video

Pilates with Katia may occasionally photograph or record classes or events for promotional, educational, or social media purposes.

When appropriate, participants will be informed or asked for permission before identifiable images or videos are used for marketing purposes.

If you do not wish to appear in photographs or video, please notify us before the class or event.

For private sessions, identifiable images or recordings will not be used for promotional purposes without appropriate permission.

19. Results Are Not Guaranteed

Individual results from Pilates instruction vary.

Factors such as consistency, physical condition, nutrition, lifestyle, medical history, effort, and other circumstances can affect results.

Pilates with Katia does not guarantee any specific fitness, strength, weight-loss, rehabilitation, flexibility, appearance, or health outcome.

20. Conduct

We want our classes and events to provide a safe, welcoming, and respectful environment.

We may refuse or discontinue service to anyone engaging in behavior that is threatening, abusive, discriminatory, disruptive, unsafe, inappropriate, or harmful to the instructor or other participants.

Where appropriate, no refund may be provided when a participant is removed due to serious misconduct.

21. Third-Party Services

Our website and business may use third-party services, including Acuity Scheduling, payment processors, email platforms, analytics providers, or other technology services.

Your use of those services may also be subject to their respective terms and privacy policies.

Pilates with Katia is not responsible for the availability, security, functionality, or independent practices of third-party platforms except as required by law.

22. Website Content

Unless otherwise stated, this content is owned by or licensed to Pilates with Katia and may not be copied, reproduced, sold, distributed, or commercially used without permission.

Sharing publicly available website or social media content through normal social media sharing features is permitted.

23. Assumption of Risk

By voluntarily participating in Pilates instruction, fitness activities, classes, events, or related services, you acknowledge that physical activity carries inherent risks.

You voluntarily choose to participate with knowledge of these risks and agree to follow safety instructions and exercise within your personal limits.

Participation may also be subject to a separate liability waiver, release, health questionnaire, or informed consent agreement.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Pilates with Katia will not be responsible for indirect, incidental, special, or consequential damages arising from the use of our website or participation in our services.

Nothing in these Terms is intended to waive or limit rights or responsibilities that cannot legally be waived under applicable law.

25. Privacy

Information we collect is handled in accordance with our Privacy Policy.

By using our website or services, you acknowledge that you have had the opportunity to review our Privacy Policy.

26. Changes to Services or These Terms

We may modify our services, pricing, policies, or these Terms from time to time.

The most current Terms will be published on our website with an updated effective date.

Your continued use of our website or services after changes become effective constitutes acceptance of the updated Terms where permitted by law.

27. Governing Law

These Terms are governed by the laws of the state in which Pilates with Katia operates, without regard to conflict-of-law principles.

Any disputes will be handled according to applicable local, state, and federal law.
